For years, Americans have been instructed to trust the science. Now, science is pleading guilty in federal court.
On Tuesday, Dr. David Morens, one of Anthony Fauci's senior advisors during the Covid-19 pandemic, pleaded guilty to conspiring to defraud the United States. The Department of Justice confirmed that Morens conspired to obfuscate Freedom of Information Act requests about his coronavirus research grants from the U.S. government by routing official government work to his personal Gmail account in order to keep the public in the dark.
The Department of Justice has released a summary of the case, which is rather damning. Morens and his collaborators conspired to cover up the termination of a bat coronavirus grant — one that had routed hundreds of thousands in NIH funds to the Wuhan Institute of Virology through EcoHealth Alliance — after COVID-19 emerged from the same region where that research was conducted. Rather than promoting transparency, they coordinated "to intentionally hide their communications from public view," the DOJ said.
The corruption runs deep enough that the DOJ has included what they are calling "illegal gratuities" in its case. Co-Conspirator 1 — widely believed to be former EcoHealth Alliance president Peter Daszak — arranged to have wine delivered to Morens' home. In return, Morens authored a scientific commentary in a prominent peer-reviewed medical journal concluding that COVID-19 had natural origins, burying the lab-leak theory that his own private communications contradicted.
"I always try to communicate using Gmail because my NIH email is FOIA'd constantly," Morens wrote in a September 2021 email unearthed by congressional investigators. The guilty plea confirms what those emails already showed.
Morens faces up to five years in federal prison. But many Americans want to know: what about Fauci himself?
Biden saw to that problem. Hours before leaving the White House, he handed Fauci a sweeping pre-emptive pardon covering actions taken between 2014 and January 2025 — a time window that conveniently encompasses the entire pandemic response. Federal prosecution is off the table. But the states aren't playing ball.
Attorneys general in Florida, Louisiana, and West Virginia have already subpoenaed Fauci as part of formal investigations into COVID guidance and financial dealings that harmed their states' citizens and businesses. Legal experts say the path forward runs through state tort law and consumer protection statutes — territory the Westfall Act cannot easily foreclose.
"I am very much in the camp that Fauci lied to the American people, and he deserves to be held accountable for those lies, both at the state and federal level," said Chad Mizelle, a former senior DOJ official and America First Policy Institute Senior Fellow.
Hans Mahncke of the Counterlawfare Institute points to Fauci's cover-up of COVID's origins as the most legally vulnerable ground. "Covering up COVID's origin to conceal Fauci's own role is fundamentally different," Mahncke said. "The government did not employ Fauci to protect Fauci. Westfall protects officials who commit wrongs while doing the government's work. It does not protect officials who use government power to hide their own wrongdoing."
The cover-up is unraveling. Morens is going down. The real question is whether the man who signed off on all of it will ever face real accountability — or whether Biden's pardon pen was the last line of defense for a man who turned American public health into his personal empire.
