US Attorney Bill Essayli is going after California Democrats who are trying to count ballots that were cast by non-citizens. The number of such ballots that the Democrats are counting is 20,000 according to a report by PJ Media. Democrat Padilla is trying to count the votes of the 20,000 non-citizens by insisting that they are all “eligible” voters.

Essayli argued that there was a federal paper trail, and that California officials had already been handed the names, addresses and dates of birth of the individuals in the flagged list, whose immigration status is stored in ‘alien files’ held by U.S. Citizenship and Immigration Services. He said that state officials could verify the immigration status of these individuals by checking the federal files against their names.

Federal database reviews were used to confirm the status of the 20,000 non-citizens. USCIS and Homeland Security Investigations (HSI) backed up that same confirmation. The roster of people who may have voted despite not being citizens was no wild guess by anyone.

A warning to officials in California has been issued by the Trump administration about possible criminal scrutiny of those conducting a vote count of newly discovered non-citizen votes. As PJ Media reports in another X post by Essayli, the warning would come under 18 U.S.C. §§ 611 and 2. The two federal statutes outlined by the U.S. Attorney allegedly detail the possible crimes of election officials who ‘knowingly’ deal with ballots of non-citizens.

The U.S. Attorney, Essayli, has asked the individual counties, as well as the Secretary of State, to keep these suspected non-citizen votes in a separate pile until verification of the citizenship of the individual can be completed using the already provided federal records. An official who refuses to honor this simple request will have to explain why he or she refused.

The PJ Media author also offers a wider constitutional argument. Under the Constitution, elections are run by the states, not the President, yet voting is a privilege reserved for American citizens. If Republicans succeed in purging the voter rolls, Democrats could therefore lose state and federal offices. These are the author's positions, and they frame the conflict between the two parties.
